TERMS & CONDITIONS

Your acceptance of the terms and conditions is given when you make a purchase / booking / order from Mark Cornick Photography. It is important to read these terms and conditions carefully before buying goods / services from the website. 

 

We will endeavour to make sure that all information on our website is accurate and correct at all times and will try to resolve all information errors on the website as soon as reasonably possible.

We are not responsible under these terms and conditions for any acts or events outside our reasonable control (force majeure), that adversely affect your purchase/ order / booking , including (but not limited to) strikes, lockouts, failures of third party systems or networks, acts of god, fire, earthquake, storm, flood or other natural disaster, civil unrest, acts of terrorism, deliberate sabotage of or malicious damage to equipment or data or for for damage to or destruction of premises or equipment.

General Terms 

Workshops and Retreats

Travel Insurance: When booking a workshop or retreat with Mark Cornick Photography, you must have comprehensive travel insurance covering cancellation (by you), any activities involved, and the destination. You are required to have travel insurance that covers any losses, expenses and damages arising from trip cancellations, accidents, injury, loss of personal items, and any flight / transportation cancellations or delays.

Making A Booking: By booking a workshop / retreat through this website and paying the agreed deposit / fee, you agree to abide by these terms and conditions. By accepting your booking, we agree to abide by these terms and conditions. We reserve the right to refuse any booking without giving a reason.

Cancellations: In the event of a cancellation from your side, we will do all we can to provide a refund to you based on any refundable costs and backfills of the space. Any cancellation by the client must be made in writing. Emails are acceptable. The date on which the letter or email is received by us will determine how much of a refund is applicable. Please note, all cancellations will be less any merchant fees paid by us and will incur a 10% administrative fee (deducted from any refund) for covering resources involved in the back-filling process.

Refunds will be calculated from the date in which you have notified us in writing:

90-60 days before commencement - 50% refund

59-31 days before commencement - 25% refund

30 days or less before commencement - 0% - not eligible for a refund

Workshop / Retreat Alterations and Cancellations: Mark Cornick Photography retains the right to cancel or alter any workshop or retreat. Should adjustments or cancellations be required, we will inform you promptly, providing the choice to accept the changes or select an alternative workshop or retreat. In cases where the alternative option is of a lower cost, the price difference will be refunded to you. Please be aware that Mark Cornick Photography is not liable for flight / travel expenses, as we are not involved in booking travel to / from the workshop location and do not receive payments for such arrangements.

Itinerary: The nature of workshops / retreats requires flexibility, and itineraries are subject to change. Itinerary descriptions should be considered indicative, rather than binding commitments.

Minimum Group Size: Workshops and retreats require a specific number of participants to operate. This number varies by workshop / retreat. In the event of a cancellation due to insufficient numbers, full payment, including the deposit will be refunded. We aim to notify you of any cancellation at least six weeks before the workshop / retreat date. Our liability is limited to amounts already paid.

Non-Transferable Bookings: Bookings cannot be transferred between participants or workshops.

Passport, Visa, and Health Requirments: All clients must hold a valid passport, along with any required visas, permits and certificates (including medical certificates) for the entire journey. It is the clients responsibility to obtain these.

Personal Responsibility and Health: Participants are responsible for their fitness and must inform us of any medical conditions / allergies at the point of booking. Compliance with the workshop leaders decisions is mandatory.

Injury and Illness Liability: Mark Cornick Photography is not liable for death, injury or illness unless due to negligence or our workshop leaders during official duties.

Age Requirements: Participants must be 18 years or older.

Force Majeure: Mark Cornick Photography disclaims liability for cancellations caused by events classified as force majeure. These include unpredictable situations beyond our control, such as acts of war, civil disturbances, terrorism, natural catastrophes, fires, floods, or extreme weather conditions.

Equipment: If any workshop or retreat leader offers their own equipment to you on loan on a workshop / retreat it is not covered by their insurance. By accepting the loan of the equipment, if it is damaged (however minor the damage) or stolen, you promise to pay immediately its full replacement value direct to the workshop / retreat leader so they can replace the item or items from a supplier of their choice who has the item or items in stock to ensure they can continue to pursue their business. If the item is no longer manufactured this clause applies to the latest new item from the manufacturer even if the value of this item is considerably higher.

Reporting Issues: We actively welcome your feedback, both in respect of our own services and those provided by other suppliers (such as accommodation providers). In the event that you have any complaint during the course of your workshop / retreat, then please bring this to the attention of of your workshop / retreat leader as soon as possible, and we will endeavour to resolve the issue to your satisfaction. Any complaints regarding accommodation should, in the first instance, be raised with the relevant accommodation provider. Should this not be possible, you should make your complaint known to us in writing within 14 days of completion of the workshop or retreat.

Privacy Policy: We only collect and retain customer information necessary to process orders, issue refunds, and provide essential information. We do not share personal details with third parties. Customers may request the deletion of their contact information by emailing: mark.cornick1@gmail.com

Data Protection: We take your privacy seriously and will always endeavour to process your personal information in accordance with applicable data protection laws. In order to process your booking and to ensure that your travel arrangements run smoothly, we will need to use personal information which you provide to us (such as your name, address, contact details, any special requirements etc). Where you have consented, we may also use the information provided to keep in touch with you and to advise you of the company's products and services (including special offers) from time to time. We will not pass your information to anyone who is not involved in providing (or arranging the provision of) any product or service related to your booking.

Acceptance of Terms: By completing the booking, you agree to these terms on behalf of all participants included in the booking.
